The integration of trade and human rights is a ubiquitous topic that has dominated academic and policy research in recent years. While it is settled that the fields of trade and human rights are distinct, the relationship between the two have become more prominent especially with the conclusion of the Uruguay Trade Round which introduced trade subjects that diminish policy space of governments.

This dissertation is not seeking to prove empirically the extent to which this understanding of property rights has been applied in the case law and statute at any given time. Rather it seeks to construct a theoretical model of the traditional, liberal approach to property rights and to use it to assess how community claims will be understood in the light of that model.
